Terms and Conditions

  • 1. Introduction
  • A. These terms and conditions represent a legal agreement between Homplan (here on referred to as 'US' or 'WE' and includes its employees) and its client or their agent/representative. (here on referred to as 'YOU' or 'YOUR')
  • B. By requesting our services and products (whether using phone, e-mail, fax, post verbally or through our website) you agree to be bound by these Terms and Conditions.
  • C. Homeplan may change these terms and conditions from time to time and will post the latest version on our website at www.homeplanuk.co.uk
  •  2. Warranties, Liabilities & General Obligations 
  • A. Homeplan warrants that it will use good care in providing the services and products. Employees will respect the property and people within them. They will remove shoes where necessary or specifically requested. They will endeavour to perform the tasks required for the service they are providing in a polite and considerate manor.
  • B. You will be responsible for providing free and safe access to the property at an agreed time.
  • C. In respect to larger properties or where multiple services are require, you will be responsible for providing access at a reasonable time to complete the service or services in one day if deemed by us to be physically possible. Appointments made for times after Mid Day where a service or services could be completed in a full day, will be subject to an additional surcharge of up to £165 for the morning lost. This may be waived at our discretion, if the morning can be productively used elsewhere.
  • D. The Client or their agent will be liable for the cost of the job within the agreed terms.
  • 3 Service Specific Warranties, Liabilities and Obligations
  • 3.1 Floor plans (Including Sketch'n'San Service)
  • A. Our floor plans are constructed in accordance with the RICS code of measuring practice and to PMA Guidelines. They are for layout guidance only. They are not to scale unless specified on the plan.
  • B. All plans provided are in draft/proof form.
  • C. It remains your responsibility to ensure that the plans are a true representation of the property and that the information within them is correct and not misleading.
  • D. After first draft we will make any amendments or changes required free of charge for one month after the date of survey.
  • E. Homeplan will accept no liability for error or omission. Any liability we may have will be limited to the cost of the service or services provided.
  • F. When plans are produced from client sketches or reproduced from other information supplied including architects drawings, no responsibility will be taken for their accuracy, or for any area information calculated from them.
  • G. When supplied with plans from third parties for reproduction we will assume all copyright permissions have been obtained by you.
  • H. If the client chooses to use the information provided in a plan including area calculations and dimension labels to pursue other matters or parties, unrelated to the sale of the property, we will have no liability or involvement in these matters.
  • I. If the client requests, or courts require our involvement in any capacity we reserve the right to charge additional fees. You will also be liable for all expenses incurred.
  • J. We guarantee all floor plans that are produced from a site visit are completed by the operator who made that visit. We do not outsource drawing work to third parties.
  • K. We will do our best to make available the floor plan to you within 48 hours of the site visit.
  • 3.2 Energy Performance Certificates
  • A. We only subcontract our EPC services to reputable registered professionals.
  • B. All work is carried out in line with their industry regulations.
  • C. We will endeavour (but not guarantee) to combine our appointments so as to cause as little disruption as possible.
  • D. We will survey a property for an EPC as accurately as possible. However, if evidence pertaining to potentially better epc result is not clearly visible it must be provided in acceptable documentary form for us to include it. We will not be liable for error or omission if documentary evidence is not available at the time of survey. RE-lodgement due to late supply of evidence will be paid for by the client.
  •    4.1 CAD Draughting Services
  • A. All CAD drawings produced by Homeplan need to be approved by the relevant, professionally qualified, structural engineer or architect before using them for in any construction work.
  • B. Any questions regarding CAD Drawings should be directed to Homeplan first. No liability will be accepted by us for error or omissions to plans, that have not been checked on site and/or questioned by the client.
  • C. We will from time to time assist in the drawing of a building or extension design, and will if require assist with design input, however we are not in a position to offer any structural integrity advice or information.
  • 4.2 Lease/Land registry plans
  • A. Lease plans, are constructed using information provided by the client or their representative. No liability will be accepted by us for error or miss interpretation of the information given.
  • B. It is you who is responsible for establishing the extent of demised and communal areas and to check the plans on completion.
  • 5.0 Fees
  • A. For the price of our products and services please contact us.
  • B. We reserve the right to change our prices at any time. All prices are available in writing on request.
  • C. Payment of all invoices is due no later than 30 days after the date of invoice.
  • D. We reserve the right to charge interest at 8% APR Compund on any amount outstanding beyond 30 days.
  • E. If the balance is outstanding for more than 90 days we reserve the right to additional admin charges of up to £500 to the outstanding amount. The charge will be added to every additional interest charge after 90 days.
  • F. There is no VAT on our invoices at this time.
  • 6.0 Intellectual property
  • A. All copyright and other intellectual property rights in and relating to the products and services provided by us shall be owned exclusively by Homeplan. You will not remove, obscure or alter Homeplan’s copyright notice, Brand Features or other proprietary rights notices affixed to or contained within any Homplan products. 
  • B. Clients or their agents may not sell, pass on or re-use floor plans without the express permission of Homeplan
  • C. in purchasing a service or product, Homplan grant you a non-exclusive, non-sublicensable licence to reproduce our plans or other products for the sole purpose for which the service was requested at the time of instruction.
  • D. licence is limited to time necessary to sell the property on that occasion up to a maximum of one year.
  • E. If the agent pays the invoice then the licence is theirs only. Other agents following who may take over the instruction to sell, will be in breach of copyright unless they buy a further licence.
  • F. If the original vendor pays the invoice, the licence is theirs for the duration of the sale on that occasion they may therefore give copies of the plan to other agents following.
  •      7.0 Archive Policy
  • A. It is our policy to archive all work we carry out subject to data protection legislation. We do this free of charge.
  • B. To retrieve files from our archives we charge an admin fee of £25 for plans archived up to two years, £50 between 2 to 7 years and £75. For anything over 7 years. (Amendments are included free but must be achievable without a return site visit).
  • C. When we are required to return to a site to update plans we have previously archived they will be charged at the standard rate at the time.  
  • D. It is your responsibility to inform us that we may have the drawing in archive before we attend a re-visit.
  • E. Due to the nature of IT equipment and the length of time we have been trading, we do not guarantee to have every job we've ever done archived.  
  • 8.0. Cancellation policy
  • A. You can cancel or postpone the appointment free of charge at any time up to 4pm the working day prior to the date of the appointment. However you will be liable for any travelling expenses (flights, ferry tickets, accommodation etc.) that have already been arranged.
  • B. If a cancellation is made after the 4pm deadline, we reserved the right to charge a cancellation fee, up to a maximum of £165.
  • 9.0. General terms
  • A. This is only between Homeplan and you. If a court decides than any part of this agreement cannot be enforced then that part will not apply. The rest of this agreement will continue to apply.
  • B. This contract is governed by the laws of England and Wales
